Annex VIII of the CLP Regulation: EU Member States Agree to a Delay in Deadlines for Mixtures

At the CARACAL meeting in September, the member states of the EU approved a draft regulation of the EU Commission. According to the draft, the reporting deadline for mixtures used by consumers will be postponed a year – from January 1, 2020 to January 1, 2021. The change is the response of the states to the wishes of trade associations and companies that had called for a one-year postponement for importers and downstream users. According to Article 45 and Annex VIII of the CLP Regulation (EU Regulation 2017/542), both the importers and downstream users are required to report on information on hazardous mixtures. The information covers the chemical makeup of the mixture, the identity of the chemical, the concentration, toxicology, and product category.

The data is to be provided to the ECHA in a uniform format, so that the competent authorities in the individual member states and the related poison centers have the same uniform information. This approach ensures that physicians can react quickly in emergencies and provide the appropriate lifesaving measures.

The EU Commission will quickly convert the draft into law, and the new regulation should take effect later this year.
